In a stealth maneuver, President Bush has signed into law a provision which, according to Senator Patrick Leahy (D-Vermont), will actually encourage the President to declare federal martial law (1). It does so by revising the Insurrection Act, a set of laws that limits the President's ability to deploy troops within the United States. The Insurrection Act (10 U.S.C.331 -335) has historically, along with the Posse Comitatus Act (18 U.S.C.1385), helped to enforce strict prohibitions on military involvement in domestic law enforcement. With one cloaked swipe of his pen, Bush is seeking to undo those prohibitions.

Public Law 109-364, or the "John Warner Defense Authorization Act of 2007" (H.R.5122) (2), which was signed by the commander in chief on October 17th, 2006, in a private Oval Office ceremony, allows the President to declare a "public emergency" and station troops anywhere in America and take control of state-based National Guard units without the consent of the governor or local authorities, in order to "suppress public disorder."

We'll be cleaning up Bush's mess long after his scheduled abdication on January 20, 2009. But the trillions of dollars in national debt he has run up and his two losing wars will drain our economy for decades to come. We've provoked a new generation of terrorists. Yet even more damaging and nearly impossible to unravel will be the threats to Americans posed by the neofascist national security apparatus the Bushists will leave behind--unless they use it to remain in power.

Shortly after 9/11 Bush began the first of a long series of power grabs that have transformed him from the leader of a country beholden to its people to an authoritarian despot. He signed a secret executive order granting himself the right to declare anyone in the world, including a U.S. citizen, an "enemy combatant"--without proof--and order him assassinated. Violating federal law and privacy rights, Bush authorized the NSA to listen to our phone calls and read our e-mail. FBI, CIA and HomeSec goons "disappeared" thousands of people into a horrible new matrix of concentration camps and secret prisons.
On October 17, 2006 Bush signed the Military Commissions Act. The new law, scarcely mentioned in the media, is breathtaking for the breadth of its attack on basic rights. Under the MCA either the president or the secretary of defense may declare you an "enemy combatant"--as usual, without proof. Under that designation you may be jailed, without the right to an attorney, for the rest of your life. You can even be tortured. Your U.S. citizenship can't protect you. And it's all "legal."

Ariz. police say they are prepared as War College warns military must prep for unrest; IMF warns of economic riots

A new report by the U.S. Army War College talks about the possibility of Pentagon resources and troops being used should the economic crisis lead to civil unrest, such as protests against businesses and government or runs on beleaguered banks.

“Widespread civil violence inside the United States would force the defense establishment to reorient priorities in extremis to defend basic domestic order and human security,” said the War College report.

The study says economic collapse, terrorism and loss of legal order are among possible domestic shocks that might require military action within the U.S.

International Monetary Fund Managing Director Dominique Strauss-Kahn warned Wednesday of economy-related riots and unrest in various global markets if the financial crisis is not addressed and lower-income households are hurt by credit constraints and rising unemployment.

U.S. Sen. James Inhofe, R-Okla., and U.S. Rep. Brad Sherman, D-Calif., both said U.S. Treasury Secretary Henry Paulson brought up a worst-case scenario as he pushed for the Wall Street bailout in September. Paulson, former Goldman Sachs CEO, said that might even require a declaration of martial law, the two noted.

State and local police in Arizona say they have broad plans to deal with social unrest, including trouble resulting from economic distress. The security and police agencies declined to give specifics, but said they would employ existing and generalized emergency responses to civil unrest that arises for any reason.

“The Phoenix Police Department is not expecting any civil unrest at this time, but we always train to prepare for any civil unrest issue. We have a Tactical Response Unit that trains continually and has deployed on many occasions for any potential civil unrest issue,” said Phoenix Police spokesman Andy Hill.

“We have well established plans in place for such civil unrest,” said Scottsdale Police spokesman Mark Clark.

Clark, Hill and other local police officials said the region did plenty of planning and emergency management training for the Super Bowl in February in Glendale.

“We’re prepared,” said Maricopa County Sheriff Deputy Chief Dave Trombi citing his office’s past dealings with immigration marches and major events.

Super Bowl security efforts included personnel and resources from the U.S. Department of Homeland Security and U.S. military’s Northern Command, which coordinated with Arizona officials. The Northern Command was created after 9/11 to have troops and Defense Department resources ready to respond to security problems, terrorism and natural disasters.

Northern Command spokesman Michael Kucharek and Arizona Army National Guard Major. Paul Aguirre said they are not aware of any new planning for domestic situations related to the economy.

Nick Dranias, director of constitutional government at the libertarian Goldwater Institute, said a declaration of marital law would be an extraordinary event and give military control over civilian authorities and institutions. Dranias said the Posse Comitatus Act restricts the U.S. military’s role in domestic law enforcement. But he points to a 1994 U.S. Defense Department Directive (DODD 3025) he says allows military commanders to take emergency actions in domestic situations to save lives, prevent suffering or mitigate great property damage.

Dranias said such an emergency declaration could worsen the economic situation and doubts extreme measures will been taken. “I don’t think it’s likely. But it’s not impossible,” he said.

The economy is in recession. Consumer spending is down, foreclosures are up and a host of businesses are laying off workers and struggling with tight credit and the troubled housing and financial markets. The U.S. Federal Reserve Bank and U.S. Treasury Department have pumped more than $8.5 trillion into the economy via equity purchases of bank stocks, liquidity infusions, Wall Street and bank bailouts and taxpayer rebates. U.S. automakers are seeking more than $14 billion in federal loans with fears they could fall into bankruptcy without a bailout. The U.S. housing and subprime lending-induced recession also has hit economies in Europe, Japan and China.

Gov. Janet Napolitano’s office declined comment on emergency planning and possible civil unrest. Napolitano is president-elect Barack Obama’s pick for secretary of Homeland Security, an agency that oversees airport security, disaster response, border security, customs and anti-terrorism efforts.

As governor, Napolitano sent National Guard troops to Palo Verde Nuclear Generating Station in 2003 in response to terrorism threats.

Glendale Police spokesman Jim Toomey said the West Valley suburb developed new emergency plans with the approach of Y2K computer changeovers leading up to the year 2000 and police have updated those plans several times including after 9/11. Toomey said strategies to deal with public unrest usually involve deploying personnel and equipment to deal with specific incidents while still providing usual services.

The U.S. army has an ad campaign on its website, looking for people who are interested in becoming an "Internment & Resettlement" specialist. The military plans a crackdown and roundup of dissidents and other "threatening 'terrorists'. "

The U.S. military is looking for people to enlist in the army and become Internment & Resettlement Specialists.
These specialists will be responsible for everyday operations at military confinement & correctional facilities and civilian law enforcement detention & internment facilities. They will also provide rehabilitative, health, welfare, and security to U.S./NATO military prisoners within confinement or correctional facilities, conduct searches and inspections, prepare written reports, as well as coordinating all activities of both prisoners and military personnel.

The U.S. military began its recruitment campaign after receiving a report from the Department of Homeland (In)Security, which warned about domestic terrorists and other extremists who pose a threat to the nation. The DHS also included a report fr
om the state of California via the DoD that all dissidents are described as "low-level terrorists."

The ad says that successful candidates will provide external security to detention & internment facilities and provide counselling and guidance to individual prisoners within rehabilitative program guidelines.
U.S. government and military officials claim that they are not aware of the Internment Camp policy, but did say that the internment camps would be used for troops trained in the U.S. and then transferred to overseas internment camps & detention facilities.

The U.S. campaign ads describe issues of advanced responsibilities, such as administration and supervision, full responsibility for the internee & prisoner camp populations, custody & control for Enemy Prisoner of War/Civilian Internee (EPW/CI) camp operations, custody & control for detention facilities, and the operation of displaced civilian resettlement facilities.

Bill HR645 or the National Emergency Centers Establishment Act is pending approval in the U.S. House of Representatives. This bill would allow FEMA to build a minimum of six detention camps throughout the U.S. on open and closed military facilities, especially those dissidents and domestic terrorists the U.S. govenment wants locked up.
For example, if you refuse to take the toxic swine flu vaccine, you will be taken to an internment camp as a threat to national security.
You will also be designated as a terrorist for opposing restrictions on firearms, travel restrictions, opposing Obama policies, and other government designated criminal activities.

The Pentagon has approached Congress to grant the Secretary of Defense the authority to post almost 400,000 military personnel throughout the United States in times of emergency or a major disaster.

This request has already occasioned a dispute with the nation’s governors. And it raises the prospect of U.S. military personnel patrolling the streets of the United States, in conflict with the Posse Comitatus Act of 1878.

In June, the U.S. Northern Command distributed a “Congressional Fact Sheet” entitled “Legislative Proposal for Activation of Federal Reserve Forces for Disasters.” That proposal would amend current law, thereby “authorizing the Secretary of Defense to order any unit or member of the Army Reserve, Air Force Reserve, Navy Reserve, and the Marine Corps Reserve, to active duty for a major disaster or emergency.”

Taken together, these reserve units would amount to “more than 379,000 military personnel in thousands of communities across the United States,” explained

Paul Stockton, Assistant Secretary of Defense for Homeland Defense and America’s Security Affairs, in a letter to the National Governors Association, dated July 20.

The governors were not happy about this proposal, since they want to maintain control of their own National Guard forces, as well as military personnel acting in a domestic capacity in their states.

Why Can’t It Happen Here?

It seems the right doesn’t have a monopoly on American exceptionalism, after all.  We’re all used to hearing right-wingers like Liz Cheney using “American exceptionalism” as a shibboleth for weeding out heresy in the foreign policy realm.

But liberals have their own version of that doctrine when it comes to the domestic functions of the state, apparently.

Recently I saw Ed Schultz on MSNBC, in the context of a story on the murdered census worker in Kentucky, running a clip of Michelle Bachmann’s comments.  She claimed that census data had been used by the government in the past to round up American citizens (namely the Japanese-American Nisei on the West coast in early 1942).  “The government rounding up American citizens?” Schultz asked incredulously.  “That goes beyond psycho talk.”

Now, I’ll be the first to stipulate that Michelle Bachmann goes beyond psycho.

But Schultz acted as though the idea of the U.S. government rounding citizens up was so ludicrous, on its very face, as not to deserve refutation.

Why?  Because the U.S. government is run by the kinds of angels that James Madison wrote of?  Because the American people are uniquely predisposed to resist authoritarianism?   Or just because there’s something “different” about the American genetic makeup, or maybe something different in the water here?

The idea of the U.S. government as an object of fear, that its growing police state powers might be used against the American people for the wholesale suppression of dissent, is hardly a right-wing preserve, as Schultz seems to suggest.

There have been plenty of left-wingers, like Frank Morales and Alexander Cockburn, who have chronicled with a great deal of alarm the upward ratcheting of the police state apparatus over the past three decades.  And there were plenty of left-wingers, myself among them, who freely used the words “dictatorship” and “dictatorial” to describe the powers conferred on the U.S. government by USA PATRIOT and the weakening of the Posse Comitatus Act.

I vividly recall my own reaction, waking up on Tuesday morning, September 11, 2001, to hear the news of the WTC bombings on my clock radio.  My first thought was not of the danger of further Al Qaeda attacks, or of the possibility that they would present a significant threat to the average American.  I figured my chances of getting hurt by Al Qaeda were about as great as getting hit by lightning.   No, I immediately thought of the heightened danger from the U.S. government.   My first thought was “Well, Bush and Ashcroft will probably be able to railroad through the FBI’s entire laundry list of police state measures they didn’t manage to force through after the Oklahoma City bombing.”  My next thought was “And they’ll give the national security state a blank check to make the world safe for corporate power, in the name of ‘fighting terrorism.’”  And guess what my third thought was?  “Oh, shit.  My Wobbly red card’s probably gonna get me put in an internment camp before this is over.”

Anyone who thinks there’s something unique in the water or in the average person’s genetic makeup that means “It can’t happen here,” should bear in mind that it already has happened here—many times.

A few years ago Peggy Treiber, a local liberal columnist here in Northwest Arkansas, wrote a pro-gun control column ridiculing the idea of private firearm ownership as a defense against government tyranny.  It was unthinkable, she said, that the government would turn against its own people.

Now, if she’d read Howard Zinn’s account of American history, she’d consider it more remarkable if the U.S. government ever STOPPED engaging in repressive action against its own people.  My God, the most important direct spur to the formation of the U.S. government in the first place was Shays’ Rebellion.  The people who’d fought the Revolution, seeing the Massachusetts state government taken over by the same Court Party that had governed them under the royal charter, decided it was time for  another revolution.  As a result, the Federalist clique of war bond speculators, mercantile and landed interests, seeing their own party almost defeated by a popular uprising in Massachusetts, perceived an urgent need for a strong central government to be ready to restore order when people like Shays’ militia took that “democracy” nonsense too seriously.

Since then, political repression of the left and of racial minorities has been a common theme throughout American history.  Woodrow Wilson’s attorney general, A. Mitchell Palmer, carried out mass arrests of political prisoners during the war hysteria and Red Scare.  Whether or not census data was actually used, FDR did in fact round up thousands of Japanese-Americans completely outside the framework of law.  The McCarran Internal Security Act provided for preventive detention of “subversives” in the event of a national emergency, and a long series of Executive Orders issued under Eisenhower and Kennedy gave the U.S. government comprehensive power to nationalize the economy and conscript the entire civilian labor force in the event of a “national emergency.”  COINTELPRO systematically destroyed a major portion of the American left in the late 1960s, through covert police action.  Ronald Reagan, as governor of California, carried out joint martial law exercises between the National Guard and state and local police, under the terms of GARDEN PLOT.  As President, Reagan conducted similar martial law exercises (REX-83 and REX-84).  Jose Padilla, an American citizen arrested on American soil, was held without charge for years and tortured into a near-vegetative state, to the point that he was no longer fit to stand trial when the Bush junta finally decided to hand him over to the regular courts.  Cheney, we recently found out, pushed to use the military to arrest the Lackawanna Six on American soil.   You may have missed it in the mainstream press’s plain vanilla coverage, but the anarchist blogosphere in September was full of first-hand accounts of federal, state, and local police officers treating the locked-down population of New Orleans as an occupied enemy.

There’s absolutely nothing in the psychological makeup of American officialdom that immunizes it against the normal functioning of Acton’s Dictum.  Walter Cronkite observed, in his early years as a newspaperman in Texas, that it was standard practice for local cops embarrassed by an unsolved crime to take some friendless drifter into a back cell and break his fingers until he “confessed,” so they could close the books on the crime.  The phrase “shot trying to escape” (as in civil rights workers) deserves a prominent place in American Orwellianisms alongside “found no evidence of wrongdoing.”

Liberals who laugh at the know-nothingism implicit in right-wing outrage over talk of American Empire, and the like, should remove the beams from their own eyes.
